The two lawsuits were filed by the American Civil Liberties Union’s (ACLU) Nevada branch and Educate Nevada Now (ENN). “Nevada’s school choice program is one of the largest, most innovative programs in the country, which is precisely why it has come under so much fire.” said IJ senior attorney Tim Keller. “It empowers parents and fosters healthy competition in the state’s education system.” Under the new law, which doesn’t go into effect until 2016, families with children in public schools can opt out of the public school system and receive a flexible scholarship to use on a wide variety of educational services—including private school tuition, tutoring, or distance learning, among other other options. They can even take classes a la carte from public schools or pay for courses at community colleges. The program puts parents in the driver's seat of their children’s education, and offers a multitude of choices to find the best fit for their kids. The ACLU’s lawsuit argues that the newly-minted program furthers a religious or sectarian purpose because it allows parents to choose religious educational options for their children. But allowing parents to make the decision about where to educate their own children severs any link between church and state. The ENN lawsuit does not make any claims regarding religion. It argues that the public school system is the exclusive means of paying for education in Nevada, but there is no reason why families should not have more say over how their own tax dollars are spent, especially when it comes to something as crucial as their children’s education. For families, ESAs will help their children escape Nevada’s overcrowded and inadequate public school system. http://ij.org/nevada-school-choice

Currently, 10 states provide a prepaid tuition plan that is accepting new applicants. Those states include Florida, Illinois, Maryland, Massachusetts, Michigan, Nevada, Pennsylvania, Texas, Virginia, and Washington. Savings Plans Savings plans are different in that all growth is based upon market performance of the underlying investments, which typically consist of mutual funds. Most 529 savings plans offer a variety of age-based asset allocation options where the underlying investments become more conservative as the beneficiary gets closer to college age. Savings plans may be administered by states only. Although states administer savings plans, record-keeping and administrative services for many savings plans are usually delegated to a mutual fund company or other financial services company. With the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA), 529 plans gained their current prominence and tax advantages. Qualified distributions from 529 plans for qualified higher education expenses are exempt from federal income tax. Legislation introduced in the U.S. House of Representatives in 2011 by Congresswoman Lynn Jenkins, (R-KS) and Congressman Ron Kind, (D-WI) that would include 529 plan contributions in the SAVERs tax credit, make permanent the inclusion of computers as a qualified expense, provide for four annual investment direction changes and provide employers with an incentive to contribute to the 529 plans of their employees. There are many advantages to the 529 plan: First, although contributions are not deductible from the donor's federal income tax liability, many states provide state income tax deductions for all or part of the contributions of the donor. Beyond the potential state income tax deduction possibilities, a prime benefit of the 529 plan is that the principal grows tax-deferred and distributions for the beneficiary's college costs are exempt from tax. Many states give the account owner a full or partial state income tax deduction for their contributions to the state's section 529 plans. So far a total of 34 states and the District of Columbia offer such a deduction. California, Delaware, Hawaii, Kentucky, Massachusetts, Minnesota, New Jersey and Tennessee currently have state income taxes but do not offer a state income tax deduction or tax credit for contributions to the state's 529 college savings plan. Alaska, Florida, Nevada, South Dakota, Texas, New Hampshire, Washington and Wyoming do not have state income taxes. Contributions to other states' section 529 plans are generally not deductible in your home state. Only Pennsylvania, Arizona, Maine, Missouri and Kansas provide for state tax parity, where contributions to any state plan are eligible for the state's income tax deduction. Second, the donor maintains control of the account. With few exceptions, the named beneficiary has no rights to the funds. Most plans even allow you to reclaim the funds for yourself any time you desire, no questions asked....

Chancellor Dan Klaich of the Nevada System of Higher Education will propose a set of tuition increases for the state's higher education institutions on Friday to the Board of Regents. Undergraduates at UNLV and the University of Nevada, Reno are expected to face an approximate 17 percent tuition hike spread out over four years starting in fall 2015. Graduates will face a total tuition increase of about 4 percent during a two-year period starting in fall 2017. UNLV administrators say the money will be used toward hiring more faculty in order to decrease class sizes and offer students the classes they need more quickly so they can graduate in a timely manner. The Board of Regents is expected to vote on whether to approve the tuition increases in June. Since 2007, tuition has risen by more than 70 percent for undergraduates at UNLV and UNR. The latest undergraduate tuition increase, an 8 percent hike approved in December 2011, was used at UNLV to improve student services like Financial Aid, according to university officials. The Rebel Yell asked students their views on the proposed tuition increases.
